Child Support

Knoxville, Tennessee: Legal Help With Child Support

Under Tennessee law, calculation of child support obligations occurs according to the state's Child Support Guidelines. There is not a lot of room for deviation outside of these statutory guidelines, which are sometimes referred to as an income shares plan. Tennessee's Child Support Guidelines take into consideration both parents' gross income, each parent's share of parenting time, cost of medical insurance and other considerations that may be relevant to determining an appropriate award amount.

If you and your child's other parent can agree on reasonable monthly child support payments within the guidelines, then you may not need legal help with that part of your divorce. There are, however, several situations when child support issues can cause serious legal conflicts. Below are just a few instances where advice from an experienced family law attorney may prove helpful, there are other situations that apply as well:

  • You suspect your spouse is hiding income, so that child support payments will be lower
  • You believe your spouse is purposefully unemployed or underemployed — earning lower wages or no wages at all to avoid paying child support
  • Your child's financial needs change significantly, and you want to seek a modification of the child support order
  • Your income or your ex-spouse's income changes significantly, and you want to seek a modification of the child support order
  • Your ex-spouse prevents you from seeing your children because your child support payments are late
  • Your ex-spouse has brought formal legal action against you because your child support payments are late
